These Terms of Service govern your use of our marketplace, and all related services. By using our platform, you agree to follow these terms.

1.1. Acceptance of Terms

By joining the server, using the dashboard, interacting with Bot 1 or Bot 2, or making any purchase, you agree to: these Terms of Service - The neutrality policy - the Privacy Policy - the Refund Policy - the Buyer Protection Policy - the Seller Agreement If you do not agree, you must leave the server and stop using the platform.

1.2. Eligibility

You must: You must be at least 13 years old to use the platform as a buyer. You must be at least 18 years old to become a seller due to Stripe’s identity and payout requirements. We may remove or ban users at any time for violating rules.

1.3. Marketplace Role Definitions

1.3.1. Buyers

Buyers may purchase digital items, services, or accounts from verified sellers. - Buyers may optionally subscribe to the Premium Buyer Membership.

1.3.2. Sellers

Sellers must complete verification and may be required to pay a Seller Subscription to list more items.

1.3.3. Staff

Staff members assist with moderation and support tasks. They do not make final decisions, enforce rules independently, or override the Founder. All staff actions are subject to Founder approval and may be reversed at any time.


1.4. Founder Authority

The Founder holds full and exclusive authority over the platform, including: rule enforcement dispute outcomes bans and removals refunds policy changes staff appointments and removals system decisions The platform is not a democracy. The Founder’s decisions are final and cannot be appealed.


1.5. Payments & Fees (Platform Products)

The following fees are platform products sold directly by the Founder, not by marketplace sellers. These fees range from $0.49 to $5.99 and follow the refund rules below.

1.5.1. Buyer Protection Fee ($0.49)

A $0.49 fee is charged per transaction to activate Buyer Protection. This fee is a platform product and is non‑refundable.

1.5.2. Seller Subscriptions (Price varies)

Seller subscriptions are platform products. Once activated, some are non‑refundable too.

1.5.3. Premium Buyer Membership ($5.99/month)

The Premium Buyer Membership is a platform product. Because the price is above $5.00, it may be eligible for a refund according to the platform’s refund rules for platform products. Refund eligibility does not follow the 7‑day order refund window unless stated in the Refund Policy.

1.5.4. Platform Product Refund Rules

Platform products under $5.00 are never refundable. Platform products $5.00 or above may be refundable according to the platform’s refund rules. Platform product refunds are decided only by the Founder.


1.6. Marketplace Order Refunds (Seller Items)

Refunds for marketplace orders follow the 7‑day refund window. - Payments under $5.00 are not refundable. - Payments $5.00 or above may be refundable within 7 days.


1.7. Listings & Transactions

1.7.2. Seller Responsibilities

Sellers must: - provide accurate descriptions - deliver items as promised - avoid scams or misleading information - respond to disputes when requested

1.7.3. Buyer Responsibilities

Buyers must: - read listings carefully - provide valid evidence in disputes - avoid false claims or chargebacks

1.7.4. Bot‑Posted Listings

All listings posted by Bot 1 are based on seller input. We are not responsible for seller content.


1.8. Disputes

1.8.1. Dispute Process

Disputes may be reviewed by staff, but all final decisions are made by the Founder. Staff cannot close, approve, deny, or finalize disputes without Founder authorization.

1.8.2. Final Decisions

The Founder has full authority over all dispute outcomes, refunds, bans, and enforcement actions. Staff opinions are advisory only.

1.9. Chargeback Abuse

Filing false chargebacks will result in: - permanent ban - blacklist - loss of Buyer Protection

1.10. Prohibited Activities

Users may not: - scam or attempt to scam - sell illegal items - sell stolen accounts - impersonate staff - spam listings - exploit bots or systems - attempt to bypass verification - harass or threaten others - Violations may result in immediate removal.

1.11. Platform Rights

We reserve the right to: - remove any listing - ban any user - modify rules at any time - update fees or subscriptions - suspend services for maintenance - terminate accounts for safety reasons - override or reverse any staff action at the Founder’s discretion - enforce rules directly without staff involvement


1.12. Order IDs, Refund Windows & Data Retention

1.12.1. Order ID Generation

A unique Order ID is generated only after Stripe confirms a successful payment. This Order ID is required for refunds, disputes, and support.

1.12.2. Refund Window for Marketplace Orders (7 Days)

Refund requests for marketplace orders must be submitted within 7 days. After 7 days, all marketplace orders are final and non‑refundable.

1.12.3. Visibility Window (40 Days)

Order details remain visible in the user dashboard, staff panel, and admin panel for 40 days. After 40 days, orders are removed from user and staff view but remain archived internally.

1.12.4. Archive Retention (4 Months)

Archived order data is retained for up to 4 months for: - fraud prevention - dispute verification - audit logs - platform safety - After 4 months, archived order data may be permanently deleted.

1.12.5. Expired Order IDs

Once an order is archived or deleted, the Order ID becomes invalid and cannot be used for: - refunds - disputes - support - verification


1.13. Website Ticket System

1.13.1. Ticket Creation

Users may open support tickets through the website for: - order issues - seller issues - buyer protection - account problems

1.13.2 Evidence Requirements

Users must provide: - Order ID (if applicable) - screenshots - proof of payment - relevant details

1.13.4 Ticket Storage

Tickets are stored for up to 4 months, matching the archive retention policy.

1.13.5. Limitation of Liability

We are not responsible for: - losses caused by user behavior - seller mistakes - buyer mistakes - misunderstandings between users - digital item issues - downtime or bot outages - You use the platform at your own risk.

1.14. Future Features & Automatic Coverage

The platform may introduce new features, tools, bots, fees, memberships, verification systems, or marketplace functions at any time. All new features are automatically covered under these Terms of Service, even if not explicitly listed at the time of release. By continuing to use the platform after new features are added, users agree to the updated rules, policies, and systems associated with those features. The Founder reserves full authority to: - launch new features - modify existing features - remove features - update pricing - introduce new platform products - adjust refund rules for new features - enforce rules related to new systems - Users are responsible for reviewing updates posted on the dashboard.


1.15. Suggestion Features & Voting System

The platform may introduce new features based on community suggestions. These suggestions are reviewed and may be enforced if approved through the official voting system. Voting applies only to optional features, improvements, and upgrades. Core platform rules, policies, and enforcement decisions are not subject to voting. - The Founder retains full authority to: - approve or reject suggestions - override votes if necessary - enforce or delay implementation - remove features at any time - Participation in voting does not grant decision-making power over platform rules.

1.16. Account Termination & Data Wipe

The Company (zophos, inc) may suspend, restrict, or permanently terminate any account at any time for safety, fraud prevention, or rule violations. When an account is terminated: - access to all platform features is removed - access to purchased items may be removed - Buyer Protection is revoked - Seller verification is revoked - all active listings are removed - all active tickets are closed - all staff actions related to the account may be reversed - Data associated with terminated accounts may be: - retained for up to 4 months for safety and audit purposes - permanently deleted after the retention period - used as evidence in disputes or investigations - Terminated users may not return under alternate accounts.

1.17. Evidence, Logs & Monitoring

The platform may collect and store: - ticket messages - dispute evidence - bot logs - order logs - verification data - moderation actions - system activity - This information is used for: - dispute resolution - fraud prevention - safety enforcement - audit verification - platform improvement Evidence and logs are stored for up to 4 months, matching the archive retention policy. - The Founder may access all logs at any time. Users consent to automated logging by using the platform.

1.18. Bot Behavior & Automation

The platform uses automated bots to: - post listings - manage orders - generate Order IDs - handle tickets - enforce cooldowns - detect suspicious activity - assist with moderation Bots act based on user input and system rules. - Bot actions are considered valid and final unless reversed by the Founder. Users may not: - exploit bots - bypass bot systems - manipulate bot commands - attempt to break automation Any attempt to exploit automation may result in immediate removal.

1.19. Seller Verification Requirements

Sellers must be 18 years or older. Minors (13–17) may use the platform as buyers but cannot become sellers under any circumstances. Providing false or misleading verification information results in permanent removal.

1.20. Feature Access & Lockouts

Access to platform features is not guaranteed. The Founder may restrict or remove access to: - dashboard tools - bot commands - listing creation - ticket creation - premium perks - seller tools - buyer tools Reasons for lockouts include: - abuse - spam - suspicious activity - rule violations - chargeback attempts - safety concerns Feature access may be restored or removed at the Founder’s discretion.


1.21. Account Ownership, Security & Sharing

1.21.1. Account Ownership

Each account on the platform is intended for use by one individual human user only. By creating an account, you agree that: - You are the sole owner of the account - You are the only person who will access or use the account - All information provided belongs to you and is accurate - You will not allow any other person to use your login credentials - Accounts may not be transferred, sold, rented, or shared under any circumstances.

1.21.2. No Account Sharing

Account sharing is strictly prohibited for security and privacy reasons. This includes, but is not limited to: - Allowing another person to log into your account - Sharing your email, password, passkey, or 2FA codes - Using someone else’s account - Creating accounts for others - Letting friends or family access your account - Why account sharing is not allowed: - Your payment information is tied to your account. - Anyone with access could make unauthorized purchases. - Your buying history is private. - Sharing your account exposes everything you’ve bought. - Your payment history is private. - Other people should never see your transactions. - Your account contains personal data. - Email, verification status, and security settings must remain private. Sharing weakens platform security. - It makes it harder to verify real humans and detect fraud. - Shared accounts break the human‑only system. One account = one verified human. No exceptions. Even sharing with a friend or family member is not allowed.

1.21.3. Security Requirements

To maintain a safe and human‑only environment, all users must: - Verify their email after signup - Use their own personal email address - Keep login credentials private - Enable additional security features when required (e.g., Google Authenticator, passkeys) - Never share authentication codes or devices - Users are responsible for all actions taken under their account.

1.21.4. Email Verification Requirement

To maintain a secure and human‑only environment, all users must verify their email address after signing up. - Accounts remain restricted until email verification is completed - Unverified accounts cannot buy, sell, post memes, or use sensitive features - A valid personal email address must be used - Verification may be required again if suspicious activity is detected - Email verification is mandatory for all users.

1.21.5. Two‑Factor Authentication (2FA) & Passkeys

For additional security, users may be required to enable: - Google Authenticator (2FA) - Passkeys (device‑based authentication) - These features help protect: - Payment information - Personal data - Account access - Seller tools - Marketplace transactions - Users must keep all authentication codes and devices private.

1.21.6. Enforcement

If account sharing is detected, the platform may take one or more of the following actions: - Temporary account lock - Forced re‑verification (email, 2FA, or passkey) - Removal of access to certain features (e.g., posting, selling) - Permanent account suspension in severe or repeated cases - Marketplace access, seller tools, and meme posting privileges may be restricted until the account is verified as belonging to a single human user.

1.21.7 Email Verification Failure Consequences

Email Verification Requirement All users must verify their email address after creating an account. Unverified accounts cannot access key features, including: - Buying - Selling - Posting memes - Using sensitive account tools - Failure to Verify If you do not verify your email: - Your account will remain restricted - You may be required to restart the verification process - You may be unable to recover your account if you lose access - Your account may be locked or removed after extended inactivity Email verification ensures the platform remains secure, human‑only, and free from automated or fraudulent accounts.

1.21.8. Two‑Factor Authentication (2FA) & Passkeys

Users may be required to enable additional security features such as: - Google Authenticator (2FA) - Passkeys (device‑based authentication) These tools protect your account, payment information, and personal data.

Recovery Policy If you lose access to your 2FA device or passkey: - You must complete identity verification to recover your account - Recovery may require email confirmation or additional security checks - The platform cannot restore access without proof that you are the legitimate account owner(email or phone) - This policy prevents unauthorized access, account sharing, and fraudulent recovery attempts.

1.21.9. Purpose of This Policy

This rule exists to protect: - Your personal information - Your payment details - Your buying and selling history - Platform security - Fraud prevention - Human‑only verification standards - One account = one human.

No sharing. No exceptions.

1.22. Appeals & Reversals

The Founder has full authority over all decisions. - Appeals are not guaranteed. The Founder may: - reverse staff actions - reverse bot actions - reverse bans - reverse refunds - reverse dispute outcomes - deny appeals without explanation Users do not have the right to demand an appeal.


1.22. High‑Value Item Category (Future Feature)

High‑Value Items are a restricted listing category intended for products priced above the platform’s automated transaction limit. This category is not currently available for public use. When activated in the future, High‑Value Items will require manual review, manual payment handling, and direct approval through the platform’s designated high‑value processing system. Users may not attempt to list or transact High‑Value Items until the feature is officially released.


This platform operates under the laws of the United States and the Commonwealth of Massachusetts. By using the platform, users agree that all disputes, claims, or legal matters are governed exclusively by Massachusetts law.

Any legal action, dispute, or claim must be handled within Massachusetts. Users waive the right to pursue claims in any other state or jurisdiction.
